Terms and Conditions for ACO Limited Online Store

- Definitions and Interpretation
1.1 In these Terms and Conditions (“T&Cs”), unless the context otherwise requires:
• ACO: ACO Limited
• Customer: The person purchasing products from the ACO online store.
• Goods: Products available for sale on ACO’s website.
• Order: A purchase made through the ACO website.
• Website: ACO’s online store at [https://eshop-aco.nz].

By using the Website and placing an Order, you agree to these T&Cs. ACO reserves the right to amend these T&Cs at any time without prior notice.

- Ordering & Order Confirmation
3.1 All Orders placed via the Website are subject to acceptance by ACO.
3.2 An Order is confirmed when the Customer receives an email confirmation.
3.3 ACO reserves the right to cancel or refuse any Order in cases of:
• Pricing or stock errors
• Suspected fraudulent activity
• Non-payment
• Any other reason at ACO’s discretion

- Pricing & Payment
4.1 Prices displayed on the Website are inclusive of GST (Goods and Services Tax).
4.2 Accepted payment methods:
• Credit/Debit Card (Visa, Mastercard, etc.)
• Afterpay
• Google Pay/Apple Pay

- Shipping & Delivery
5.1 Delivery is available within New Zealand.
5.2 Estimated delivery times are based on standard NZ delivery: 1-2 working days for North Island, 3-4 working days for South Island.
5.3 ACO grants free shipping for orders
5.4 Risk of loss or damage passes to the Customer upon delivery.
5.5 If an order is lost or damaged in transit, ACO is responsible for replacement or refund.
5.6 Customers must report missing or damaged goods within 48 hours of delivery for claims to be processed.

- Returns & Refunds
6.1 ACO complies with the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986.
6.2 Customers may return products within 14 days if:
• The product is faulty
• The wrong item was received
• The product is significantly different from its description
6.3 Change of Mind Returns:
• Accepted within 14 days.
• If accepted, product must be unused, in original packaging, and returned at the customer’s expense.
6.4 Refunds will be processed within10 business days to the original payment method.
6.5 Return shipping costs for faulty items: Paid by Customer.

- Risk & Ownership
7.1 Ownership of Goods remains with ACO until full payment is received.
7.2 Risk of loss or damage passes to the Customer upon delivery.
7.3 If payment is not received, ACO reserves the right to reclaim Goods from the Customer, subject to applicable laws.

8.1 ACO collects and stores personal information in compliance with the Privacy Act 2020.
8.2 Personal data collected:
• Name, address, and contact details
• Payment information (processed securely)
• Order history
8.3 Data is used for:
• Order fulfillment
• Customer service

8.4 Data is shared with:
• Payment processors
• Delivery partners

9.2 Accounts suspected of fraudulent activity may be suspended or terminated.

- Force Majeure
10.1 ACO shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, supply chain disruptions, or governmental actions.

- Dispute Resolution & Governing Law
11.1 In case of disputes, customers should contact ACO at info@aconz.co.nz before taking further action.
11.2 Disputes will be governed by New Zealand law and resolved in NZ courts.
11.3 Before pursuing legal action, parties are encouraged to attempt mediation.
